Judicial Review can be used where there is no right of appeal or where all venues of appeal have been exhausted. The applicant whose application is refused by the UKVI/Home Office and is not granted a right of appeal will have the opportunity to apply for Judicial Review. Before the procedure of review starts, the pre-action protocol application is sent to UKVI to review their decision in 14 days and if they do not change their decision then an application for Judicial Review can be filed.
